DRAFT MINUTES

 

                    MARION TOWNSHIP 

    ZONING BOARD OF APPEALS

             NOVEMBER 3, 2003

 

MEMBERS PRESENT:   John Lowe, Dan Lowe, Linda Manson-Dempsey, Larry Fillinger,

                                            Dan Rossbach

MEMBERS ABSENT:       None

OTHERS PRESENT:        Robert Hanvey, Township Supervisor

                                            Annette McNamara, Zoning Administrator

CALL TO ORDER

John Lowe called the meeting to order at 7:30 p.m.

APPROVAL OF AGENDA

Larry Fillinger made a motion to approve the agenda.  Linda Manson-Dempsey seconded. Motion carried 5-0.

APPROVAL OF MINUTES

Dan Rossbach made a motion to approve the minutes from September 8, 2003.  Linda Manson-Dempsey

seconded. Motion carried 5-0.

Linda Manson-Dempsey pointed out on top of page three, name should be LaBlanc.

Larry Fillinger made a motion to approve the minutes from October 6, 2003 as amended.

Linda Manson-Dempsey seconded.  Motion carried 5-0.

OLD BUSINESS    

Case #05-03 – Fraternal Order of Eagles

Art Munsell appeared on behalf of the Fraternal Order of Eagles. The sign and easement detail maps were discussed.

The dimensions reflected were wrong and changed to 6 x 21 with no dimensions on inside.  Eight foot was changed to six

foot. The numbers at the sign base should all be removed. Linda Manson-Dempsey confirmed that the digital text on the

sign would be stationary. John Lowe referenced the memo dated October 7, 2003 from Annette McNamara, last sentence

in the first paragraph that states, “The ZBA can allow the continuance of a non-conforming use and allow the sign to be

put up within the same footprint (historical use).” Linda Manson-Dempsey made a motion to approve Case #05-03,

Fraternal Order of Eagles, to put up the sign as they have submitted with the changes made on the drawing and initialed by

both the applicant and John Lowe, Chairperson:  The Zoning Board of Appeals will allow the continuance of a

non-conforming use and allow the sign to be put up within the same footprint as the historical use. 

Motion carried 4-0.  Larry Fillinger, no.

John Lowe stated for the record that the approval of this sign would not affect the ability of adjacent landowner to place

a sign on his property. After discussion the Board agreed to note a statement of policy as follows:

  Linda Manson-Dempsey declared a statement of policy for parcel/Tax ID # 4710-01-300-021.

The placement of the Eagles pre-existing non-conforming sign within the easement (on the above noted parcel) dedicated

for the signage.  This will not adversely affect the placement of an additional sign on the above noted parcel.  The additional

sign and placement must conform to the zoning ordinance at the time of site plan review.
