CALL TO ORDER

The meeting was called to order at 7:00 p.m.

APPROVAL OF AGENDA

Jean Root motioned to approve the agenda for April 7, 2004 Ordinance Workshop.  Dave 

Hamann seconded.  Motion carried 5-0.

CALL TO THE PUBLIC

APPROVAL OF MINUTES

Page 11 of 12 noted to include letters submitted at that time.  Debra Wiedman-Clawson

requested clarification in the February 27, 2004 minutes on a letter submitted by Galina 

Zwerlein, 2501 Clivedon, which included an attachment of the International Fire Code 

(IFC).  John Lowe suggested the minutes be amended to note that the letter included a 

copy of the IFC, for reference.  Jean Root motioned to approve the minutes as amended 

dated February 24, 2004 Regular meeting.  Jim Anderson seconded.  Motion carried 5-0.

John Lowe informed the Planning Commission of a conversation with Mike Boss regarding 

the IFC and site plans submitted in other communities if not in effect at this point it will 

incrementally be enforced in the future in respect to entrances.

OLD BUSINESS

Site Plan Review Applications

Comments from the Board of Trustees are going to be incorporated into the document by 

John Ambrose, changes will be submitted for the Planning Commission to review at the

 April 27, 2004, Planning Commission meeting.  As a courtesy the Planning Commission 

will send to the Board of Trustees for their review.

Jean Root motioned to table Site Plan Review Application with corrections by John Ambrose 

by the April 27, 2004 Planning Commission meeting.  Jim Anderson seconded. Motion 

carried 5-0.

Planning Commission Rules and Procedures of 1996

Jean Root questioned page two - second paragraph bold print two-year term limitation, is 

everyone comfortable with this? John Ambrose responded this gives everyone a chance to 

function in that role.  It is up to the Planning Commission to accept or reject.  Secretarial 

position—discrepancies in the old document were changed.  Date of the meeting and 

agenda layout were changed to reflect current conditions.  Call to the Public (CTP) agenda 

items only may be changed to include any item a resident would like to discuss. This would

 prevent a resident from sitting thru an entire meeting for an opportunity to talk. 

 John Lowe is concerned discussion is kept at two to three minutes. Jean Root suggested 

using verbiage from attorney.  Simply say “duly noted” and move on. 

Discussion ensued.  Because a resident submits a letter or at the CTP brings up an issue 

does not mean the Planning Commission has to act on it during the meeting.  The Planning 

Commission needs time to review prior to comment. Dave Hamann questioned item seven.

Planning Commission agreed to strike. John Ambrose reviewed additional changes to the 

document.  No changes were major, mainly to bring the document up to date.  All changes 

are in bold (see document.)  Any changes the Planning Commission would like to make in the

future will only require three positive votes from the Planning Commission.

Jean Root questioned page three, under referral.  Would like to see that changed to a 

responsibility of the Zoning Administrator and/or Assistant.  Conflict on page four and under 

order of business regarding the persons and the development of the agenda.  Make the 

development of the agenda a responsibility of the Zoning Administrator and/or Assistant.  

Page three regarding special meetings. John Ambrose clarified the process of arranging a 

special meeting.  Can be called at a meeting or initiated at an administrative level.

Discussion on Planning Commission members and conflict of interest.  John Ambrose can

reverse the order of the language. Jean Root motioned to table Planning Commission Rules 

and Procedures of 1996 rewrite for April 27, 2004 Planning Commission meeting with corrections 

made by John Ambrose.  Jim Anderson seconded.  Motion carried 5-0.

NEW BUSINESS

The meeting was called to order at 7:40 pm.

APPROVAL OF AGENDA

Jean Root motioned to approve the agenda for April 7, 2004 Comprehensive Planning meeting.  

Jim Anderson seconded.  Motion carried 5-0.

CALL TO THE PUBLIC

Mary Ann Bahr, 3201 Grass Lake Court - Is it possible to get a copy of the draft comprehensive

plan to review and comment on?

John Ambrose stated it is a draft document and is available for review prior to the public hearing,

at the township hall during regular business hours. 

Kathleen Kline Hudson replied.  We have one more working session prior to sending the draft 

document to the Township Board to be approved for distribution. According to the Comprehensive 

Planning Act, draft copies are to be distributed to surrounding communities and Livingston County.

At that point we can put it in the library and the hall for other persons to review. Surrounding 

communities and Livingston County have between 75 and 95 days to review and comment. 

The Livingston County Planning Commission will make a recommendation to the Marion Township 

Planning Commission, to have a public hearing and to adopt the night of the public hearing or 

make changes and then adopt. The Planning Commission discussed different ways to make the

document available to the public for viewing.

APPROVAL OF MINUTES

Discussion of the antiquated recording system was discussed by the Planning Commission. 

John Ambrose suggested placing the microphone on a podium to get a better recording of

audience members during Call to the Public.  Some communities have a sign in sheet for people 

who want to speak during the meeting. Dave Hamann agreed to take this issue to the Board of 

Trustees. Debra Wiedman-Clawson left the meeting at approximately 8:00 p.m.

Jean Root motioned to approve the minutes dated February 26, 2004 Comprehensive Planning 

meeting.  Jim Anderson seconded.  Motion carried 5-0.

OLD BUSINESS

Kathleen Kline-Hudson handed out the first six chapters and her business card.  She and asked the 

Planning Commission to review and send changes to her.

Revisions to Completed Chapters

Title page, acknowledgments and table of contents were distributed and reviewed.  Minor change

to chapter one.  Chapter two the census information was updated.  Housing value updates.

Jean Root asked about updating the census information yearly?

Kathleen Kline-Hudson will put the Planning Commission on her mailing list to send census 

statistics on a yearly basis to use as a tool in planning.

Chapter three - Natural Features, maps were integrated with the passage of text it is related to.  

Last page, last paragraph regarding natural features has additional language about methods of 

preserving natural features, such as open space preservation ordinance.

Chapter four transportation - maps integrated with text.  Level of Service (LOS) map was discussed. 

The Livingston County Road Commission (LCRC) does not have an updated version.

Jean Root asked does our new text refer to LOS? John Lowe answered no.

Kathleen Kline-Hudson said the LCRC relies more on traffic count data and the GRIP Gravel Road

Improvement Plan to make decisions. John Lowe stated we always ask for their comments on 

site plans we review. Kathleen Kline-Hudson inserted SEMCOG Traffic Crash Data on pages 32 

and 34.  This can be removed if it is not useful.  Can be added to Appendix, then you can have 

full database available for your reference.

The Planning Commission agreed to use the top fourteen of the SEMCOG Transportation Tool 

Handout. Jean Root asked if the LOS language in our current Master Plan is enough to base 

decisions on. John Ambrose you have to be careful not to get into site plan issues.

John Lowe stated the Planning Commission asks for maximum build out numbers to use as a

building block for decisions.  Our engineer reviews using the maximum numbers, to see the 

potential impact of rezoning. Jean Root stated they are not denied due to traffic studies.

Jean Root is concerned they have gone from a section of policy that talks about LOS, maximum 

recommendations for travel and asked now to give it up. Jim Anderson asked if there is a 

capability rating for roads? John Ambrose yes.

John Lowe suggested chapter four Transportation be sent to Phil Westmoreland, Township 

Engineer for his review and comment.  Forward review and comment to Kathleen Kline-Hudson 

as soon as possible. Kathleen Kline-Hudson will add 2003 Traffic Count from MDOT and LCRC

when comprehensive plan is complete. 

Future Land Use Chapter Eight

Kathleen Kline-Hudson handed out a copy. Dave Hamann would like to see the acreage on the

legend. Kathleen Kline-Hudson - Keep the yellow area confined to the parcels that abut the lake. 

Changes suggested.

       The major roads and lakes labeled.  The four largest lakes, Coon Lake, Triangle Lake, Pleasant 

    Lake and Cedar Lake

  Blue Sewer and Water boundary line a different color or line type for clarification

    Add the CSX Railroad

 Remove blue outlines on 1-96

    Loop Road added

 Label City of Howell

 Increase size of map to cover entire page

Jean Root asked for clarification of designations.  Suburban Residential and Suburban Residential 

with sewer/water.  The zoning district and land use classification are the same name. How can we

state this without confusion?   Can use Sewer High Density Residential.

Kathleen Kline-Hudson asked for help in making sure all designations on the future land use map 

are correct. Kathleen Kline-Hudson pointed out the public facilities easement thru the two lots, 

the color will need to be changed. Two lots at north end near Wright Road. Also, leave the 

Medium Density Residential to the east of Marion Oaks Golf Course the color it is.

Implementation Chapter Nine

Kathleen Kline-Hudson gave an overview of chapter nine it is basically how to use the 

Comprehensive Plan. Kathleen Kline-Hudson reviewed the decision matrix. This should be

updated every five years.  Does the Planning Commission want to keep or remove.

Kathleen Kline-Hudson will change on the decision matrix; direct access to paved roads for 

commercial and industrial should be high priority and the following.

      Add the verbiage to high priority for location/remove the word factor

    Page three update designation verbiage

    Remove ERS-2

 Page four Planned Unit Development - called a zoning district - change to overlay

 Remove square footage in the third paragraph

Completion of Comprehensive Plan

Kathleen Kline-Hudson gave a synopsis for completion and handed out a list of items completed 

and items to be completed.  The draft Comprehensive Plan should be ready to send to the Board 

of Trustees. Concerns about changes to the document and public hearings.  If at the time of the 

public hearing, the Planning Commission feels there are too many suggested changes to consider 

for a decision to be made at the meeting, a decision can be made to postpone the public hearing

to a date certain. This way any residents who attend the public hearing will know when the next 

meeting will be held. Jean Root motion to set the next Comprehensive Planning meeting for 

May 17, 2004 at 7:30 p.m.  Jim Anderson seconded.  Motion carried 5-0.
