John Lowe called the regular meeting of the Zoning Board of Appeals to
order at 7:35 p.m.

APPROVAL OF MINUTES

Call to order time of 7:30 p.m. and Adjournment time of
9:00 p.m. needs to be inserted into minutes.

minutes, as amended. Dan

seconded. Motion
carried 4-0.
October 7, 2002
Change date of August 21, 2002 minutes to September 9, 2002.

OLD
BUSINESS
ZBA case number
19-02: Lance Pettis
Mr. Pettis
would like to put a pole barn in the front yard of his property.
Previous barn was burnt in 1995.
Lot is 3.1 acre size with a 186 foot of frontage on D-19.
The proposed structure is 38 foot by 88 foot with a
12 foot entrance
to allow access for his large boat to be stored.
The total height of the barn is 18 foot.
Per letter from Mr. Ambrose, dated October 14, 2002, he has determined this
is not a flag lot but rather an irregular
shaped lot.
Mr. Pettis will shorten the length to 70 foot but would like the width at 38
foot because he has already
purchased building material to accommodate this
size.

Motion
Dan Rossbach motioned to approve ZBA case number 19-02 for Lance Pettis
allowing a pole barn, changing
dimensions to 38 foot by 70 foot, to be built
in his front yard. To grant a
variance for a front yard accessory structure
relaxing ordinance 8.01 F 3 a
and granting a 55 foot variance for a front yard setback relaxing ordinance
6.07.3,
meeting 5.05 C 2 requirements due to practical difficulties with
shape and condition of his property. Dan
Lowe
seconded. Roll call vote:
Rossbach-yes, Fillinger-no, John Lowe-yes, Dan Lowe-yes.
Motion carried 3-1.
NEW BUSINESS
Catherine
Szabelski- 3158 Pingree Howell, MI, stated she feels Ms. Miller should be
able to put structure back
in the original location and should not need to
come before this board. She would like to purchase a set of
Marion Township
Ordinances.
Motion
Dan Rossbach motioned to approve ZBA case number 20-02 for Kay Miller,
granting a variance relaxing
Section 6.07.1 ordinance, allowing total square
foot to exceed 3:1 ratio of her home due to the fact original barn has
burnt
down. Meeting requirements in
Section 5.05 C 2, 6, and 7. Referencing
plan dated November 4, 2002 signed
by John Lowe and Kay Miller.
Larry Fillinger seconded. Roll
call vote: Rossbach, Fillinger, John Lowe,
Dan Lowe-all yes. Motion carried
4-0.

Annette McNamara noted that there
are 3 agenda items for the December 2, 2002 meeting. Currie Drive agenda
item will be a lengthy discussion and will
be placed first on the agenda. The
agenda is considered full and is closed
for additional items at this time.
Robert Hanvey stated there is an upcoming
opportunity in March of 2003 to attend a
two-day class on citizen planner
provided by the Michigan State Cooperative Extension.
