Lowe called the regular meeting of the Zoning Board of Appeals to order at
7:32 p.m. APPROVAL
OF AGENDA
Larry Fillinger motioned to approve the agenda of May 5, 2003. Linda Manson-Dempsey seconded. Motion
carried 5-0. OLD
BUSINESS
Case
#01-03—Cesarz John Lowe indicated that the township was sent a transcript from the court reporter that attended the March 3, 2003 Zoning Board of Appeals (ZBA) meeting. The court reporter attended the meeting at the request of Mr. Paul Burns, attorney for Mr. Russell Cesarz (ZBA
Case #01-03). The Zoning Board of Appeals (ZBA) reviewed the transcript of the March 3, 2003 meeting provided by Mr. Cesarz, as well as the township’s minutes from the meeting. John Lowe pointed out errors in the transcript provided by Mr. Cesarz. For example, in several sections, the 18,000 square foot amount was transcribed as 1800 square foot. Also, the ERS district was referred to as the RS district. Annette McNamara will forward a list of these inaccuracies to the
Mike Kehoe, the township attorney. The ZBA reviewed the township’s minutes page by page. All members of the board concurred that pages one and two are correct as presented. Page three should be corrected to more accurately reflect comments made by Roger Pashak in the Call to the Public. Page four should have
the wording changed to indicate the township has multiple ERS districts.
Linda Manson-Dempsey motioned to approve the section of the minutes pertaining to ZBA Case
#01-03—Cesarz as amended. Dan
Rossbach seconded. Motion
carried 5-0. APPROVAL
OF MINUTES Linda Manson-Dempsey motioned to approve the remainder of the ZBA minutes (portions not dealing with
ZBA Case #01-03) from March 3, 2003 as presented.
Larry Fillinger seconded. Motion
carried 5-0. ZBA
Case #21-02—Castle Annette McNamara indicated that the time has expired for Mr. Castle’s variance request, and he has not resubmitted any additional information. Linda Manson-Dempsey motioned to remove ZBA #21-02—Castle and close the case, effective May 5, 2003, due to no response from applicant. Dan Rossbach seconded. Roll call vote: Rossbach, Fillinger, Manson-Dempsey, J.Lowe,
Dan Lowe—all yes.
Motion carried 5-0. CALL
TO PUBLIC Linda Manson-Dempsey pointed out that index pages from the transcript provided by Mr. Cesarz as missing. Ms. Manson-Dempsey also felt that the transcript was not transcribed verbatim and she was quoted inaccurately. ADJOURNMENT Dan Lowe motioned to adjourn at 8:22 p.m. Linda Manson-Dempsey seconded. Motion
carried 5-0.
